AM I INCLUDED?

This lawsuit is brought under the Fair Labor Standards Act ("FLSA") on behalf of both past and present Staples Sales Managers. To be eligible to join or "opt in" to this action alleging failure to pay wages under the Fair Labor Standards Act ("FLSA"), you must be a past or present Staples Sales Manager, who at any time during the liability period was not paid for all of the hours worked for Staples, Inc. or who was denied your legally mandated overtime pay.

The plaintiff who brought the lawsuit has asked the court to let it proceed as a "collective action." Past and present Staples Sales Managers can join in the lawsuit if they submit a consent to join form. If you do not file a written consent to join form, then you cannot join the lawsuit and will not benefit if the Plaintiffs prevail on their FLSA claims.

You may be eligible to become part of the current lawsuit if you worked for Staples, Inc. as a Sales Manager.

Please be advised that the "statute of limitations" for your FLSA claim is generally measured from the date that you submit your "Consent to Join" form, rather than the date the Plaintiff first brought the case. The statute of limitations for a FLSA claim generally is a minimum of two years and a maximum of three years from the date the written consent form is submitted. This means that time period for your FLSA claim will begin either two or three years prior to the date you submit your "Consent to Join" form. Thus, if you believe that you meet the above criteria and that you have a claim against Staples, Inc. under the FLSA, you should obtain, fill out and return a "Consent to Join" form as soon as possible.
