Overtime Collective Action Lawsuit Against Staples, Inc.
Introduction
A former employee of Staples, Inc. filed a nationwide collective action lawsuit¹ alleging that the large office supply retailer, Staples, Inc., violated overtime and minimum wage laws throughout the country, and failed to properly pay him overtime. The lawsuit, Stillman v. Staples, Inc. charges Staples with violating the federal Fair Labor Standards Act (FLSA). The nationwide case was filed in the U.S. District Court for New Jersey. Factual Allegations
It is alleged that Staples, Inc.'s Sales Managers have been misclassified as exempt from the FLSA's overtime rules, thereby denying past & current Sales Managers their compensation for their overtime hours worked.
Relief Sought
The lawsuit is seeking back pay for all hours worked under the federal Fair Labor Standards Act (FLSA). The lawsuit seeks payment of the wages earned, as well as double damages and any other available relief, on behalf of the plaintiff.
